Abstract:

Tato práce pojednává o zákonu známém jako Lex Schwarzenberg. Práce má 7 kapitol a postupně pojednává o historii a důvodech vzniku zákona. O tom co mu předcházelo, jak se historicky vyvíjela situace, co vedlo k přijetí zákona a jaké byly následky V první kapitole je pojednáno o historii šlechtických rodů v Čechách, zvláštnostech české šlechty a o zrušení šlechtictví. Druhá kapitola vysvětluje jednotlivě pojmy znárodnění, vyvlastnění, zestátnění a konfiskace. Prostřednictvím těchto institutů docházelo k odnětí majetku a jejich převodu na stát. Kapitola třetí pojednává o historii rodu Schwarzenbergů v Čechách, postupně prochází a popisuje činnost rodu v období do roku 1918, potom v letech 1918 až 1945 a popisuje i jednotlivé vybrané osobnosti rodu, zejména JUDr. Adolfa Schwarzenberga a také konfiskaci majetku rodu německými úřady. Kapitola čtvrtá pojednává o událostech v Československu krátce po druhé světové válce a vlivu těchto událostí na vznik zákona Lex Schwarzenberg. Kapitola pátá popisuje samotný proces vzniku zákona Lex Schwarzenberg včetně obou návrhů zákona a přijetí druhé návrhu zákona a reakci JUDr. Adolfa Schwarzenberga. Kapitola šestá rozebírá samotný obsah zákona a zabývá se jeho jednotlivými ustanoveními. Kapitola sedmá nahlíží na dopady zákona Lex Schwarzenberg v době tehdejší a jeho zasahování do současnosti, a to i restituce.

Abstract:

Diploma thesis is focusing on a law called "Lex Schwarzenberg". The text is composed of 7 chapters that are concentrating on the history of this law and its origins. The first chapter is about the historics of the aristocrats in Czechia, their peculiarities and their demise. The second chapter is explaining concepts of nationalization, expropriation and confiscation. By those means private property was taken and transferred to the state as its belonging. The third chapter is dealing with the history of the Schwarzenberg family in Czechia, describing activities of this family till 1918 and then from 1918 to 1945 and important figures of the family tree, particularly JUDr. Adolf Schwarzenberg. The fourth chapter is about events that occurred in Czechoslovakia after the II. World War and the impact on the foundation of Lex Schwarzenberg. Chapters five and six are describing the creation of Lex Schwarzenberg and its contents in detail. The final chapter is discussing the impacts of Lex Schwarzenberg in the past and in the present, including restitution.
