Dominant Position and its Abuse by Pricing Practices

Abstract:

Disertační práce je zaměřena na právní ochranu proti zneužití dominantního postavení na relevantním trhu prostřednictvím cenových praktik. V úvodní části je vymezen základní právně-ekonomický rámec soutěžního práva. Druhá část se zabývá jednak pojmem dominantního postavení obecně (jeho kritérii a jejich aplikačním významem) a obecným konceptem zneužití dominance a jeho jednotlivých aspektů. Třetí část je již zaměřena přímo na cenové praktiky zneužití - excesivní ceny, predátorské ceny, stlačování marží, protisoutěžní rabaty a diskriminační ceny. V rámci každé kapitoly je rozebráno jak ekonomické pozadí a podstata praktiky, tak právní regulatorní přístup.

Abstract:

The thesis is focused on the law against abuse of dominant position on the relevant market by pricing practices. In the introductory section the text deals with the law & economics frame of the competition policy. The second part concerns with both the general concept of dominance and its anticompetitive abuse in detail. The third part deals with the pricing practices - excessive pricing, predatory pricing, margin squeeze, anticompetitive rebate schemes and price discrimination.
