Psychological and tactical aspects of child interrogation

Abstract:

The aim of this thesis was to find out if recommended and legally established procedures for child interrogation were followed. Base for our research was the theoretical part of the thesis. The data were collected through questionnaire with specific questions but also with a space for respondent to express his opinion. This research showed us that there are still some deficiencies in the child interrogation process. The main problem was inadequate explanation of Miranda warnings and also some of the respondents stated that they felt pressured during the interrogation. The research resulted in a few referrals which are mentioned in the research results part of the thesis. Simultaneously the thesis contains specific examples which can help interrogator with rapport or to identify mental level or possible disorders of the child. Next there are also some specific examples for the interrogator to help him correctly communicate with the child and later evaluate credibility of the statement.

Abstract:

Táto diplomová práca sa zaoberá psychologicko-taktickými aspektami výsluchu detí. Cieľom bolo zistiť, či sa doporučené a zákonom stanovené postupy pri výsluchu detí naozaj dodržiavajú. Podkladom výskumu bolo teoretické spracovanie práce. Zber dát prebiehal formou dotazníku, ktorý obsahoval štruktúrované otázky smerované na konkrétnu skupinu ľudí. Výskum preukázal, že výsluchová prax zaoberajúca sa deťmi má ešte stále nedostatky, a to hlavne v oblasti poúčania o právach vypočúvajúceho či prítomnosti nátlakových praktík počas výsluchu. Z výskumu a štúdia danej problematiky vyplynulo niekoľko doporučení, ktoré sú uvedené vo výsledkoch výskumu. Zároveň sú v teoretickej časti práce uvedené konkrétne príklady, ktoré môžu pomôcť vypočúvajúcemu nadviazať psychologický kontakt, zhodnotiť vývojovú úroveň či prípadne poruchy dieťaťa, správne s dieťaťom komunikovať a následne aj vyhodnotiť vierohodnosť danej výpovede.
