Deductibility with a focus on joint redress of spoust

Abstract:

Předložená rigorózní práce si klade za cíl popsat a zanalyzovat jeden z institutů insolvenčního práva, oddlužení. Speciální pozornost je věnována problematice společného oddlužení manželů. V úvodu jsou stručně představeny základní pojmy, které se k dané problematice váží a současně je v základních obrysech popsáno insolvenční řízení. Hlavní část práce se pak věnuje problematice oddlužení, a to od podání insolvenčního návrhu, příp. insolvenčního návrhu spojeného s návrhem na povolení oddlužení, přes povolení oddlužení a jeho schválení jednou se zákonem upravených forem, až po jeho ukončení. Prostor je věnován také očekávané novele insolvenčního zákona a odměně insolvenčního správce. Závěrem je provedena komparace institutu oddlužení v České republice a v Rakouské spolkové republice.

Abstract:

The presented thesis aims to describe and analyze one of the institutes of insolvency law, debt relief. Special attention is paid to the issue of joint redress of spouses. In the introduction are presented basic concepts that are related to the given issue and at the same time basic inscriptions are described in insolvency proceedings. The main part of the thesis deals with the issue of debt relief, from the submission of the insolvency proposal, the insolvency proposal connected with the proposal for authorization of debt relief, the authorization of debt relief and its approval with one of the legally modified forms, until its termination. The space is also devoted to the expected amendments to the insolvency law and the reward of the insolvency administrator. In conclusion, a comparison of the debt relief institute in the Czech Republic and the Austrian Federal Republic is made.
