Abstract:

Cílem disertační práce je ověřit hypotézu komplementarity práva ochrany spotřebitele a práva duševního vlastnictví. K naplnění tohoto cíle slouží zkoumání jednotlivých zvláštních zákonů práva duševního vlastnictví z pohledu ochrany práv a zájmů spotřebitele. Tomuto zkoumání nejsou podrobeny všechny zvláštní zákony, pouze ty, u kterých je vztah ke spotřebitelským právům podle názoru autorky nejzřetelnější. Jsou to především právní normy týkající se označování výrobků, tj. zejména zákon o ochranných známkách, zákon o označení původu výrobků a zeměpisných označení, problematika doménových jmen. Východiskem práce, je kategorický požadavek veřejnoprávní normy, zákona o ochraně spotřebitele, který zakazuje klamat spotřebitele, přičemž stanoví, že možným způsobem klamání je i nabízení výrobků a služeb porušujících práva duševního vlastnictví. Pozornost je věnována hlavně zákonu o ochranných známkách z toho důvodu, že uplatněním ochranné známky při označování výrobků a jejich propagaci zřejmě nejčastěji dochází ke klamání spotřebitele. Další části práce jsou věnovány soutěžnímu právu, ochraně proti nekalé soutěži, vztahu mezi autorským zákonem a ochranou spotřebitele, ochraně osobnostních práv spotřebitele a prostředkům ochrany práv duševního vlastnictví.

Abstract:

The dissertation aims at verifying a hypothesis that in individual specific rules regulating the objects of intellectual property rights can be found provisions directly or indirectly protecting consumers. Or, that legal rules of consumer protection help protect rights of intellectual property owners. In the dissertation the author verifies the starting hypothesis of complementariness of the law of consumer protection and the law of intellectual property. In order to achieve that goal the author analyzes individual specific laws concerning intellectual property from the standpoint of protection of rights and interests of consumers. Not all specific laws are analyzed, only those where the relation to consumer rights is most obvious according to the author. They are first of all the legal rules concerning the designation of products, i.e. the Trade Marks Act, the Act on Designation of Origin of Products and Geographical Indications and the issues relating to domain names. This part of the dissertation follows the categorical requirement of a public law rule, the Consumer Protection Act, which prohibits deceiving consumers and establishes that deceiving may also consist in offering products and services breaching intellectual property rights. The following parts of the dissertation are concerned with competition law, protection against unfair competition, the relationship between the Copyright Act and consumer protection, the consumer personal rights and means of protection of intellectual property rights.
