Tax Risks Minimization Project at the Newly Established Branch of a Selected Company in the Russian Federation

Abstract:

Diplomová práce je zaměřena na problematiku založení pobočky firmy XY a. s. v Ruské federaci se zaměřením na minimalizaci daňových rizik této pobočky. V teoretické části práce je kladen důraz na daňové systémy obou států včetně zákonů, které se týkají správy da-ní. Dále je v teoretické části provedeno srovnání obou daňových systémů s důrazem na daňové povinnosti, které se nově založené pobočky budou týkat. Zmíněna je také smlouva o zamezení dvojího zdanění, uzavřená mezi Českou republikou a Ruskou federací. Praktická část práce obsahuje charakteristiku dané společnosti včetně její finanční analýzy. V další části je charakterizována nově zakládaná pobočka včetně její právní formy, jsou zpracována doporučení ohledně jejího fungování zejména z pohledu plnění daňových povinností. V závěru je uvedeno, jakým postihům organizace dodržováním těchto doporučení přede-jde.

Abstract:

Diploma thesis deals with the issue of the establishment of a branch of company XY plc. in the Russian Federation with a focus to minimization the tax risks of this branch. In the the-oretical part, emphasis is placed on the tax systems of both states, including tax administra-tion laws. Furthermore, in the theoretical part, both tax systems are compared, with an em-phasis on the tax obligations that apply to newly established branch. Also mentioned is a double taxation treaty concluded between the Czech Republic and the Russian Federation. The practical part of the thesis contains the characteristics of the company, including its financial analysis. The next part describes the newly established branch including its legal form, recommendations on its operation are elaborated, especially from the point of view of fulfillment of tax obligations. In conclusion is indicated, what sanctions the organization avoids by observing these recommendations.
