Debt discharge as a way to solve bankruptcy

Abstract:

Diplomová práce se zabývá oddlužením, upravovaném v zákonu č. 182/2006 Sb., o úpadku a způsobech jeho řešení (insolvenční zákon), s důrazem na nedávnou novelu (zákon č. 64/2017 Sb.). Cílem diplomové práce je objasnit, jakým způsobem se změnila rovnováha a postavení mezi věřitelem a dlužníkem a jestli se střetly úmysly zákonodárců s očekávanými výsledky. První část přibližuje jednotlivé části právní úpravy oddlužení. Je postupováno chronologicky dle zákona pro větší srozumitelnost. Pokud je k dispozici vhodná komparace novely se starší úpravou, je tak v této části provedeno. Další část je věnována shrnutí dopadů této novely a to hlavně ve spojitosti s potencionální změnou rovnováhy mezi dlužníkem a věřitelem. Dále je přiblížena potenciálně nová novela, která je projednávána. Nakonec jsou v závěru shrnuty veškeré poznatky a výsledky práce.

Abstract:

The diploma thesis deals with debt discharge, which is regulated in Act. no. 182/2006 Coll., On Bankruptcy and Its Resolution (Insolvency Act), with emphasis on a recent amendment to the Act (Act. no. 64/2017 Coll.) The aim of the thesis is to explain how the balance and position between the creditor and the borrower has changed and whether the intentions of the legislators have been met with the expected results. The first part describes the various parts of the regulation of debt discharge. It is chronologically followed in accordance with the law for greater clarity. If there is a suitable comparison of the amendment with the older version, it is done in this section. The next part is devoted to summarizing the impact of this amendment, mainly in connection with the potential change in the balance between the debtor and the creditor. Next, a potentially new amendment that is being discussed is explained. Finally, all the findings and the results of the work are summarized.
