Abstract:

Tato bakalářská práce se zabývá mezinárodní obchodní arbitráží, kterou zde srovnám s řízením před obecnými soudy. Kapitola pojednávající o mezinárodním rozhodčím řízení definuje tento pojem jako vhodný způsob řešení soukromoprávních sporů o majetkové nároky vzniklé z mezinárodního styku mezi fyzickými a právnickými osobami. Samostatným řízením nepředkládají strany tento spor státnímu soudu, ale na základě platně uzavřené rozhodčí smlouvy delegují pravomoc řešit spor rozhodčím řízením. Dále zde představuji prameny mezinárodní obchodní arbitráže a to zejména Newyorskou úmluvu o uznání a výkonu cizích rozhodčích nálezů a Evropskou úmluvu o mezinárodní obchodní arbitráži. Práce představí i rozhodčí smlouvu a její formy. V zahájení a průběhu rozhodčího řízení uvádím, jak lze určit rozhodné právo, podle kterého se bude posuzovat meritum sporu. Důležitým prvkem mé práce je také vzájemný vztah mezi obecnými soudy a rozhodčím řízením, kde zdůrazním procesní a kontrolní funkce soudu. Závěr mé práce se zabývá uznáním a výkonem cizích rozhodčích nálezů a vztahem mezinárodního rozhodčího řízení k obecným soudům.

Abstract:

This thesis deals with international commercial arbitration, which will compare the proceedings before the ordinary courts. Chapter dealing about the international arbitration defines this term as a convenient way to deal with private disputes over property claims what is arising from the international relations between natural and legal persons. It is not submit a separate proceeding by the state court dispute, but on the basis of an arbitration agreement validly delegate the power to settle the dispute by arbitration. Furthermore, I present the sources of international commercial arbitration, especially the New York Convention on the Recognition and Enforcement of Foreign Arbitral Awards and the European Convention on International Commercial Arbitration. Work is also presenting arbitration agreement and their forms. In the beginning and during the proceedings, I would determine how the law under which it will assess the merits of the dispute. An important element of my work is also the relationship between the general and arbitration courts, which emphasize the procedural and control functions of the court. Finally part of my work deals with the recognition and enforcement of foreign arbitral awards and international arbitration related to the general courts.
