The Correcting and the Special Correcting Meanings in the Tax Acting

Abstract:

ANNOTATION The main characteristic of this work is to describe the operation mechanisms of tax control, ordinary and extraordinary legal review means in the tax proceedings. The work oneself deals with the legal enactment of the tax proceeding as an independent legal proceeding, tax administration with the accent on ordinary and extraordinary legal review means. Review means encompass the legal possibility of protecting tax payers’ interests, when they feel, that the decision could have affected or violated their rights or by law safeguarded interests, eventually that they do not agree with the decision itself for various reasons. Review means serve primarily on the rectification of subjective influence in the proceeding. Legislator explicitly distinguishes between proper a ordinary and extraordinary legal review means as independent institutes of the tax proceeding. The own aim of this work is to describe the tax control, ordinary and extraordinary legal review means, their genera, their application and essentials. The people concur with the tax control more frequently than with ordinary and extraordinary legal review means in the tax proceeding. The reasons for election of this topic was the reality, that this issue oneself is not sufficient drawn to attention.

Abstract:

ANOTÁCIA Hlavnou charakteristikou práce je popísanie mechanizmov fungovania daňovej kontroly, riadnych a mimoriadnych opravných prostriedkov v daňovom konaní. Práca sa zaoberá právnou úpravou daňového konania ako samostatného konania a správy daní s dôrazom na riadne a mimoriadne opravné prostriedky. Opravné prostriedky premietajú v sebe zákonnú možnosť ochrany práv a právom chránených záujmov daňových subjektov, keď majú pocit, že rozhodnutím mohli byť dotknuté, resp. porušené ich práva a právom chránené záujmy, prípadne s rozhodnutím z rôznych dôvodov nesúhlasia. Opravné prostriedky slúžia najmä na nápravu subjektívnych vplyvov v konaní. Zákonodarca jednoznačne rozlišuje medzi riadnymi a mimoriadnymi opravnými prostriedkami ako samostatnými inštitútmi daňového konania. Vlastným zámerom tejto práce je opísať daňovú kontrolu, riadne a mimoriadne opravné prostriedky, ich druhy, ich aplikáciu a špecifiká. S daňovou kontrolou sa ľudia stretávajú častejšie ako s riadnymi a mimoriadnymi opravnými prostriedkami v daňovom konaní. Dôvodom voľby témy bola skutočnosť, že tejto problematike sa nevenuje dostatočná pozornosť.
