Right to a Lawful Judge in the Context of Excessive Length of Proceedings

Abstract:

Tématem této diplomové práce je problematika práva na zákonného soudce v kontextu nepřiměřené délky řízení v souvislosti s dlouhodobější nepřítomností soudce a práva na projednání věci bez zbytečných průtahů. V první části práce jsou analyzována východiska tohoto střetu jak v teorii, tak v rozhodovací praxi Ústavního soudu. V druhé části práce je zkoumáno, jak je tento střet řešen v praxi vybraných českých soudů. Jako základ pro zhodnocení, zda současný přístup k řešení střetu mezi právem na zákonného soudce a právem na projednání věci bez zbytečných průtahů odpovídá teoretickým předpokladům, slouží analýza rozvrhů práce.

Abstract:

The thesis will focus on the issue of the right to a lawful judge in the context of unreasonable length of proceedings in connection with the long-term absence of a judge and the right to expedite the case without unnecessary delays. First part of the thesis examines the foundations for resolving the conflict between these rights both in legal theory and in the case law of the Constitutional Court. Second part investigates how this conflict is addressed in the practice of selected Czech courts. An analysis of work schedules serves as the basis for evaluating whether the current approach to resolving the conflict between the right to a lawful judge and the right to expedite the case without unnecessary delays aligns with theoretical assumptions.
