Abstract:

Téma mé diplomové práce zní Způsoby zániku pracovního poměru. Cílem této práce je výklad jednotlivých způsobů zániku pracovního poměru mezi zaměstnancem a zaměstnavatelem. Nejdříve se zabývám základní charakteristikou pracovního poměru a právních úkonů. Dále se zabývám jednotlivými způsoby zániku pracovního poměru: skončením pracovního poměru dohodou, výpovědí, okamžitým zrušením pracovního poměru a zrušením pracovního poměru ve zkušební době. Dále toto pojednání v jednotlivých kapitolách rozšiřuji o problematiku skončení pracovního poměru uzavřeného na dobu určitou, zánik pracovního poměru cizinců a fyzických osob bez státní příslušnosti, hromadné propouštění a odstupné. Největší pozornost jsem věnovala skončení pracovního poměru výpovědí ze strany zaměstnavatele, se kterou je spojena řada institutů chránících zaměstnance před bezdůvodným ukončením pracovního poměru. Na závěr se věnuji neplatností právních úkonů vedoucích ke skončení pracovního poměru.

Abstract:

Title of my diploma thesis is Ways of employment termination. The purpose of the diploma thesis was to analyze individual ways of termination of the labor relationship between the employee and the employer. At first I dealt with general description of the labor relationships and labor legal acts. Then I enumerated and described the ways of termination of labor relationships in general ways recognized by law. I dealt with closer description of the bilateral legal act upon which the rights and obligations in labor relationships are terminated ? agreement of the parties. The next chapter described the most common way of termination of legal relationship by the notice of termination of employee and the employer. Then I described an instrument called immediate termination of the labor relationship, the termination of the labor relationship in the trial period followed by the termination of the labor relationships by lapse of time. I also dealt with the dismissal of employees who are not Czech citizens and the legal regulation of severance pay. The final chapter focused on the issue of the invalidity of the termination legal act.
