Europeanization of the constitutional justice focusing on the Constitutional Court of the Czech Republic

Abstract:

Předmětem práce je teoretické a praktické zkoumání evropeizace ústavního soudnictví, a to se zaměřením na český Ústavní soud. Teoretická část spočívá v rozpracování obecného konceptu evropeizace pro oblast soudnictví, přičemž je využito dělení evropeizace na základě průběhu (vertikální sestupná, vertikální vzestupná a horizontální), konvergence (pozitivní a negativní) a předmětu (obsahová a procedurální stránka). Teoretické závěry jsou následně aplikovány na vybraná klíčová rozhodnutí Ústavního soudu, jejichž analýzou je zjištěna přítomnost a povaha evropeizace v českém ústavním soudnictví.

Abstract:

The subject of the thesis is a theoretical and practical examination of the Europeanization of the Constitutional Judiciary, with a focus on the Czech Constitutional Court. The theoretical part consists of the elaboration of a general concept of Europeanization in the field of judiciary, using the division of Europeanization based on the course (top-down, bottom-up and horizontal), convergence (positive and negative) and subject (content and procedural aspects). Theoretical conclusions are then applied to selected key decisions of the Constitutional Court, whose analysis reveals the presence and nature of Europeanization in the Czech constitutional judiciary.
