Position of Custom Bodies within Criminal Proceedings

Abstract:

Bakalářská práce na téma Pověřené celní orgány v postavení orgánů činných v trestním řízení popisuje a vysvětluje, jaké postavení mají pověřené celní orgány, coby orgány činné v trestním řízení a také některé další záležitosti, které s trestním řízením a Celní správou souvisejí. V úvodní části je popsáno trestního řízení a jeho stádia. Následuje seznámení se subjekty trestního řízení se zaměřením na postavení policejních orgánů obecně a na jejich působnost a oprávnění. V další části je nastíněna struktura Celní správy, její úkoly a působení ve sféře odhalování trestné činnosti. Dále je uveden výčet trestných činů, spadajících do kompetence Celní správy a rozbor trestných činů, kterými se pověřené orgány celní správy v praxi nejčastěji zabývají. Třetí části je věnována pověřeným orgánům celní správy, jejich postavení policejního orgánu, procesním postupům a vztahu ke státnímu zástupci. V rámci úkonů prováděných pověřeným celním orgánem jsou popsány nejpoužívanější kriminalistické metody. V předposlední části jsou uvedeny statistické výsledky celní správy v oblasti trestního řízení a v poslední shromážděny informace o mezinárodní spolupráci v této sféře.

Abstract:

The thesis authorizing „Position of Custom Bodies within Criminal Proceedings“ describes and explains the position you are responsible for customs, as the bodies active in criminal proceedings and also some other issues that the criminal proceedings and the Customs Administration related. In the introductory section describes the criminal proceedings and its stages. Followed by the introduction to subjects of criminal procedure, focusing on the position of police in general and on their duties and privileges. The next section outlines the structure of the Customs Administration, tasks and activities in the area of crime detection. Below is a list of crimes falling within the competence of the Customs Administration and analysis of crimes, which are responsible for the customs authorities, in practice most often involved. The third part is devoted to the competent organs of the customs administration, the position of a police authority, process and procedures related to the prosecutor. The operations carried out by authorized customs authority describes the most common forensic methods. In the penultimate section provides statistical results of the customs administration of the criminal proceedings and recently collected information on international cooperation in this sphere.
