Legislation of co-ownership and accessory to the co-ownership

Abstract:

V české právní úpravě je institut spoluvlastnictví aktuálně zakotvený v zákoně č. 89/2012 Sb., občanský zákoník (dále jen „OZ 2012“), který nabyl účinnosti dne 1.1.2014, a který přinesl do právní praxe řadu změn. OZ 2012 se liší od předchozí právní úpravy zakotvené v zákoně č. 40/1964 Sb. (dále jen „OZ 1964“) množstvím nových zákonných ustanovení týkajících se věcných práv a znovuzavedením právních institutů, které existovaly a jsou známé již z minulosti. S občanským zákoníkem tak byl například zaveden do praxe institut přídatného spoluvlastnictví, který je upraven v §§ 1223-1235 OZ 2012. Podstatou zakotvení právní úpravy přídatného spoluvlastnictví je úprava situací vznikajících při potřebě nebo nutnosti užívání společné věci několika výlučnými vlastníky, kteří jsou zároveň vlastníky jiné věci označované jako věc hlavní.

Abstract:

In the Czech legislation, the co-ownership institute is currently enshrined in Act No. 89/2012 Coll., The Civil Code (hereinafter referred to as “OZ 2012”), which came into effect on 1 January 2014 and which brought changes to the legal practice. The most difference from the previous legislation enshrined in Act No. 40/1964 Coll. ('the 1964 Commercial Code') is a number of new legal provisions concerning the law and the reintroduction of legal institutes that existed and are known from the past. With the Civil Code it was introduced into the practice of the institute of accessory to the co-ownership, which is regulated in §§ 1223-1235. The essence of the legal regulation of accessory to the co-ownership is to regulate situations arising in the need or necessity of using the common thing by several exclusive owners who are also the owners of another thing known as the main thing.
