Abstract:

Tato bakalářská práce se věnuje smlouvám o užívání cizích věcí, s konkrétním zaměřením na nájemní smlouvy bytu. Práce podává ucelený přehled o stávající právní úpravě nájmu bytu. Zaměřuje se také na historický vývoj nájmu bytu. Nadále poukazuje na poměr ochrany práv jednotlivých stran nájemních vztahů. pojednává na téma, zda je dnes nájemce dostatečně chráněn z pozice slabší strany a v jaké pozici je dnes podnikatel v rámci ochrany práv a povinností. V praktické části je zpracována vzrová nájemní smlouva, s přihlednutím na všechny zákonné požadavky, a čerpá z konkrétních nájemních smluv využívaných v praxi. Nakonec, ve druhé praktické části pojímá nájem z podnikatelského hlediska a vymezuje podnikatelské výhody a rizika.

Abstract:

This bachelor thesis deals with contracts of using the things of someone else, with a particular focus on apartment rent. The thesis provides a comprehensive overview of the existing apartment rent legislation. It also focuses on the historical development of the contracts of apartment rent. It continues to point to the ratio of protection of the rights of individual parties. It deals with the topic of whether the tenant is sufficiently protected from the weaker party position and in what position the entrepreneur is today in the framework of the protection of rights and obligations. In the practical part, the rent contract is drawn up, taking into account all legal requirements, and draws on the concrete rent contracts used in practice. Finally, in the second practical part, apartment rent is taken from a business perspective and defines business advantages and risks.
