Defence to the Possession Claims

Abstract:

Tato diplomová práce je zaměřena na analýzu komplexní ochrany držby. Práce se nejdříve zabývá pojmem držby v obecném slova smyslu, vymezením ochrany držby a k tomu užitých právních prostředků. Tyto prostředky jsou rozebrány jak po stránce hmotněprávní, tak procesní. Práce přitom vychází z komparace úpravy obsažené v občanském zákoníku č. 89/2012 Sb. a v obecném zákoníku občanském. Cílem práce je podání souhrnného pohledu na danou problematiku a nastínění možností využití dřívější právní úpravy a judikatury pro výklad stávajících ustanovení nového kodexu.

Abstract:

This thesis is focused on the analysis of complex protection of tenure. First, the work deals with the concept of tenure in general, the definition of protection of tenure and the legal means used for it. These legal means are analysed from both sides, the substantive and the procedural. The thesis is based on the compare of the provisions contained in the Civil Code no. 89/2012 Coll. and the General Code Civil. The aim of this work is to summarize the view on the issue and to show the possibilities of using the former legislation and jurisprudence for the interpretation of the existing provisions of the new Civil Code.
