Abstract:

The thesis Preliminary Ruling Procedure and acte claire and acte éclairé doctrines deals with the importance of this institute which makes the interpretation and application of European law uniform. This thesis is divided into five main parts. In the first section is situated the subsumption of the preliminary reference procedure within the whole system of European law. Who, how, what and when to refer to the ECJ approximates the second section. The attention should be paid to statistic data which bring the information about the quantity and assignment of subjects of preliminary ruling procedures. The third section deals with the exceptions from duty of preliminary reference to the ECJ - the acte claire and acte éclairé doctrines. This section explains their meaning, importance and reason of their introduction. The following section brings nearer the details about the consequences of the breach of duty of preliminary reference to the ECJ and the liability of State to damages caused by deviation of the court of last resort. In the last section of this thesis are mentioned some interesting cases from the area of judicial decisions of the ECJ and the Constitutional Court of Czech Republic. The final part contains concluding remarks. This part of thesis tries to draw up some solutions to lighten the agenda of the ECJ and by this to shorten the length of the preliminary ruling procedure.

Diplomová práca na tému prejudiciálne konanie a doktrína acte claire a acte éclairé sa zaoberá dôležitosťou tohto inštitútu, ktorý robí výklad a aplikáciu európskeho práva jednotnou. Práca je členená do piatich častí. Prvá kapitola začleňuje prejudiciálne konanie v rámci celého práva EÚ. Kto, na čo, kedy a ako sa pýtať v konaní o predbežnej otázke približuje druhá kapitola. Za pozornosť stoja štatistické údaje, ktoré prinášajú informácie o množstve a predmetovom určení prejudiciálneho konania. Tretia kapitola sa zaoberá výnimkami z povinnosti podať predbežnú otázku (acte claire a acte éclairé), ich významom a dôvodom zavedenia. Nasledujúca kapitola prináša podrobnosti o následkoch porušenia povinnosti predložiť predbežnú otázku a zodpovednosti štátu za škodu spôsobenú pochybením súdu posledného stupňa. Posledná kapitola sa zaoberá zaujímavými prípadmi v judikatúre Súdneho dvora a Ústavného súdu ČR. Záver zhrňuje poznatky, ktoré v práci vyplynuli a načrtáva možné riešenia k odľahčeniu agendy Súdneho dvora a tým k skráteniu celkovej doby trvania prejudiciálneho konania.
