The Procedural Aspects of the Administrative Expulsion

Abstract:

The aim of this master’s thesis is to provide a complex overview of the decision-making process regarding an administrative expulsion of foreigners. The aforementioned process is governed by several regulations. The most important of which are the Rules of administrative procedure and the Act on the Residence of Foreign Nationalities in the Czech republic, as regards special legislation. These statutes in combination with acquis communautaire create legal boundaries within which the administrative authority, the police, takes actions. They also set standards that shall be accessible to the foreigner. The legislation is compared in various chapters of the thesis with empirical knowledge obtained in non-governmental organizations and the Office of the Public Defender of Rights. The result is a comprehensive overview of specific stages of the administrative expulsion proceeding at which departures from legislation most commonly occur and where an adequate legislation is completely absent. The thesis also offers possible solutions to the problematic parts of the decision-making process and de lege ferenda proposals.

Abstract:

Zmyslom tejto diplomovej práce je priniesť komplexný pohľad na proces rozhodovania o správnom vyhostení cudzinca. Problematika priebehu rozhodovania je upravená viacerými predpismi. Najdôležitejším z pohľadu línie tohto procesu je správny poriadok a z pohľadu zvláštnej úpravy je významným zákon o pobyte cudzincov. Tieto zákony spolu s komunitárnou úpravou vytvárajú mantinely, v ktorých by sa správny orgán, polícia, mal pohybovať a zároveň stanovujú štandardy, ku ktorým by mal mať cudzinec prístup. Zákonnú úpravu v jednotlivých kapitolách komparujem s poznatkami z praxe v neziskových organizáciách, zameraných na cudzincov a v Kancelárii Ombudsmana. Výsledkom je ucelený pohľad na to, kde v procese rozhodovania o vyhostení cudzinca nastávajú odchýlky od právnej úpravy alebo v ktorých prípadoch adekvátna právna úprava absentuje. Práca prináša aj možné riešenia problematických oblastí rozhodovania a návrhy de lege ferenda.
