The meaning and the purpose of the punishment and the amount of satisfaction in the criminal proceedings from the perspective of restorative justice

Abstract:

Restorativní justice je konceptem, který zdůrazňuje, že trestný čin nenarušuje jen právní normy, ale především mezilidské vztahy a vazby. Hlavním restorativním nástrojem k nápravě trestným činem způsobených škodlivých následků slouží restorativní justici dialog, a to v podobě restorativních programů. Právě dialogická rovina řešení následků trestné činnosti má významný dopad i pro dvě základní témata této práce, kterými jsou “smysl a účel trestu” a “rozsah zadostiučinění”. V rámci kontextu českého trestního práva je připomínáno, že podstata restorativní justice nespočívá v zavádění alternativních trestů k trestu odnětí svobody či ve snaze rozšiřovat procesní možnosti stávajících institutů odklonů od trestního řízení. Restorativní přístup od nás žádá změnu úhlu pohledu na to, co jsou v návaznosti na způsobený trestný čin naše priority a pomocí dialogu umožnit vnést do trestního řízení osobní rovinu a individuální řešení dané věci. Uvedené pojetí je promítnuto do stávající podoby hmotněprávní a procesní úpravy české trestněprávní legislativy tak, aby obě trestněprávní roviny byly schopné do sebe smysluplně integrovat a zohlednit veškeré výsledky restorativních procesů a současně účastníkům poskytly odpovídající ochranu jejich procesních práv. Závěr této práce patří využití restorativních hodnot, principů a nástrojů v oblasti českého systému vězeňství.

Abstract:

Restorative justice is a concept which underlines that the criminal act violates not only the legal regulations, but mainly the inter-personal relationships and bonds. The key restorative tool to rectify the damages resulting from the criminal act is the dialogue in the form of restorative programmes. It is the very dialogue level of approaching the after-effects of crime which has a great impact also on the two key themes of this dissertation: “the meaning and purpose of punishment” and “the scope of satisfaction”. Within the Czech legal context, it is underscored that the core of restorative justice does not rest in the implementation of sentences alternative to the imprisonment or in the efforts to extend the process possibilities of the existing practices diverting from criminal proceedings. The restorative approach requires us to change the perspective of looking at what our priorities are in relation to the inflicted criminal act and, through a dialogue, enable introducing the personal context and individual solution of the case into the criminal proceedings. The above approach is reflected in the existing design of the substantive and process Czech criminal legislation in a way which would enable both criminal law contexts to be able to meaningfully integrate and take into consideration all the results of restorative processes whilst providing the participants with relevant protection of their procedural rights. The closing part of this dissertation is dedicated to the use of restorative values, principles and tools in the Czech prison service.
