Minimum Standards under the Regulation No. 805/2004 creating a European Enforcement Order for Uncontested Claims

Abstract:

Tato diplomová práce se zabývá problematikou minimálních norem v Nařízení č. 805/2004, kterým se zavádí evropský exekuční titul pro nesporné nároky. První část práce je zaměřena na zavedení evropského exekučního titulu ve formě nařízení, působností tohoto nařízení a podmínkami pro vydání potvrzení evropského exekučního titulu. Stěžejní část práce se zabývá analýzou minimálních norem, které se týkají poučovací povinnosti soudu a stanovených forem doručování, a jejich srovnáním s českou právní úpravou. V závěru práce je zhodnocen soulad českého právního řádu s minimálními normami a dopad minimálních norem na postavení věřitele a dlužníka v řízení.

Abstract:

This thesis deals with the issue of minimum standards under the Regulation No. 805/2004 creating a European Enforcement Order for Uncontested Claims. The first part of the thesis is focused on the implementation of the European enforcement order in the form of the regulation, on the scope of this regulation and on the requirements for certification as a European Enforcement Order. The main part of the thesis deals with the analysis of minimum standards which are concerned with the information duty of the court and with defined forms of the service, and the comparison of minimum standards with the Czech legislation. Finally, the thesis assesses the conformity of the Czech legislation with the minimum standards and their impact on the creditor's and debtor's position in the proceedings.
