Abstract:

Disertační práce se zabývá vlivem francouzské školy veřejných financí na finanční vědu a právo ve vybraných evropských zemích, a to v Německu, Itálii, Československu, České republice s přesahem na možné formování unijních veřejných finančních mechanismů. V této souvislosti je proto zkoumána evoluce francouzské finanční vědy a práva, resp. je zkoumána francouzská škola veřejných financí. Analyzovaná evoluce francouzské finanční vědy a práva je následně porovnána s evolucí finanční vědy a práva v Německu, Itálii, Československu, resp. České republice. V disertační práci je také zkoumána evoluce vybraných unijních veřejných finančních mechanismů. V průběhu výzkumu byly analyzovány odborné publikace především francouzských autorů, ale také autorů italských či německých. V disertační práci byla také analyzována vybraná pozitivní právní úprava práva veřejných financí. S ohledem na zjištěné výsledky získané po studiu doktrinálních pohledů, jakož i pozitivního práva zkoumaných zemí, je určen vliv francouzské školy veřejných financí na finanční vědu a právo zkoumaných zemí, a to vč. přesahu na vybrané unijní veřejné finanční mechanismy. K výsledkům výzkumu také patří zjištění vzájemného ovlivňování vývoje veřejných financí mezi Francií, Německem a Itálií, které přispívalo k vytvoření nových tvůrčích podmínek, jež umožnily vznik nové kvality francouzské školy veřejných financí. V disertační práci byly také definovány pojmy francouzská škola veřejných financí a veřejné finanční mechanismy.

Abstract:

Tne thesis deals with the influence of the French school of public finance on financial science and law in selected European countries, namely in Germany, Italy, Czechoslovakia, and the Czech Republic, with implications for the possible formation of EU public financial mechanisms. In this context, the evolution of the French financial science and law is therefore examined, or rather the French school of public finance is examined. The analyzed evolution of the French financial science and law is subsequently compared with the evolution of financial science and law in Germany, Italy, Czechoslovakia, respectively in the Czech Republic. The thesis also examines the evolution of selected EU public financial mechanisms. In the course of the research, specialized publications of mainly French authors, but also Italian and German authors, were analyzed. Selected positive legal regulation of public finance law was also analyzed in the thesis. With regard to the results obtained after the study of doctrinal perspectives as well as the positive law of the studied countries, the influence of the French school of public finance on the financial science and law of the studied countries is determined, incl. overlap with selected Union public financial mechanisms. The results of the research also include the discovery of the mutual influence of the evolution of public finance discipline between France, Germany and Italy, which contributed to the creation of new creative conditions that enabled the emergence of a new quality of the French school of public finance. The terms French school of public finance and public finance mechanisms were also defined in the thesis.
