Termination of Employment Relationship in Aspect of Legal Regulation of the Czech Republic

Abstract:

Skončení pracovního poměru z hlediska právní úpravy České republiky Anotace: Tématem této práce je právní úprava skončení pracovního poměru z hlediska právní úpravy České republiky. V úvodu práce je poskytnut stručný průřez nejdůležitějšími změnami v zákoníku práce dotýkající se právní úpravy skončení pracovního poměru. Nejprve jsou vysvětleny základní pojmy, jako je pracovní poměr a jeho subjekty. Dále se práce věnuje přímo tématu skončení pracovního poměru ve světle právní úpravy České republiky. Zde jsou podrobně rozebrány veškeré způsoby skončení pracovního poměru, tak jak je upravuje právní řád České republiky. Jednotlivé kapitoly práce jsou věnovány dohodě o rozvázání pracovního poměru, výpovědi, okamžitému zrušení pracovního poměru, zrušení pracovního poměru ve zkušební době, problematice hromadného propouštění. Následuje výklad o neplatném rozvázání pracovního poměru a nárokům z neplatného rozvázání pracovního poměru plynoucích. Speciální kapitola je věnována zvláštní ochraně při skončení pracovního poměru. Vedle jednotlivých způsobů skončení pracovního jsou uvedeny právní události, s níž zákoník práce skončení pracovního poměru spojuje. Následuje rozbor způsobů skončení pracovního poměru v některých zvláštních případech a rozsáhlý výklad o nárocích souvisejících se skončením pracovního poměru. V závěru práce je rozebrána mezinárodněprávní úpravu v oblasti skončení pracovního poměru a to jak v rámci dokumentů Evropské unie, tak v rámci dokumentů Mezinárodní organizace práce.

Abstract:

Termination of employment relationship in aspect of legal regulation of the Czech Republic Annotation: The theme of this thesis is the legal regulation after the termination of employment relationship in aspect of the legal regulation of the Czech Republic. The introduction of the thesis provides a brief cross-section of the most important changes of the Labor Code concerned with the legal regulation after the termination of employment relationship. At the beginning, basic concepts are explained, such as the employment relationship and its subjects. Further on, the thesis deals directly with the theme of the employment relationship termination in aspect of the legal regulation of the Czech Republic. All ways of the termination of employment relationship are analyzed in detail as they are regulated by the legal order of the Czech Republic. The individual chapters of the thesis are devoted to the termination of employment by agreement; termination of employment by notice of dismissal; termination of employment by instant dismissal; termination of employment by dismissal during the probationary period; problems of collective redundancies. An explanation is given of an invalid termination of employment relationship as well as entitlements resulting from the invalid termination of employment relationship. A special chapter is devoted to a particular protection at the termination of employment relationship. In addition to the individual ways of the termination of employment relationship also legal events are described, which the Labor Code associates with the termination of employment relationship. Following is the analysis of the ways of the termination of employment relationship in certain special cases, and an extensive explanation of the entitlements connected with the termination of employment relationship. At the end of the thesis, the international legal regulation is analyzed, which is concerned with the termination of employment relationship, both in the European Union documents and in the documents of the International Labor Organization.
