The System of Sanctions in the Budget Law

Abstract:

This diploma thesis describes the system of sanctions in the budgetary law. The thesis gener-ally defines the place of the budgetary law in legal system. Further the thesis describes the control of the budget management with a reference made to the review of the municipal budg-et management. A substantial part of the thesis is focused on the definition of sanctions and subsequently on the definition of specific sanctions for violation of duties of pecuniary and non-pecuniary nature. The aim of the thesis is to analyze effectiveness of the legal regulation in the Czech Republic. The conclusion of the thesis compares the sanctions regulated by the budgetary law and proposes possible legislation amendments.

Abstract:

Diplomová práca sa zaoberá systémom sankcií v rozpočtovom práve. V práci je obecne vy-medzené zaradenie rozpočtového práva medzi ostatnými právnymi odvetviami. Ďalej práca popisuje kontrolu rozpočtového hospodárenia, a to s odkazom na preskúmavanie rozpočtového hospodárenia územných rozpočtov. Podstatná časť práce je potom zameraná na vymedzenie pojmu sankcia a následne na vymedzenie konkrétnych sankcií za porušenie povinností peňažnej a nepeňažnej povahy. Cieľom práce je analyzovať efektívnosť stávajúcej právnej úpravy v Českej republike. V závere práca porovnáva sankcie upravené rozpočtovým právom a navrhuje možné legislatívny zmeny.
