Diplomová páce se zabývá problematikou nového pojetí moderace smluvní pokuty. Nejprve je stručně shrnuta nová koncepce a její odraz v navazující judikatuře, která byla vydána v uplynulém roce. Abstract:
This diploma thesis deals with a new concept of the moderation of contractual penalty. A summary of the new concept and its reflection in subsequent case law in the previous year is provided. The relevant moment for the assessment of whether a contractual penalty is excessively high is also discussed. The thesis then concerns the issue of the criteria for determining the excessiveness.
