Limits of Religious Expression in Contemporary Democratic States

Abstract:

Meze a svobody náboženského vyznání jsou složitou problematikou. Tato práce se zabývá nejprve historickým souvislostmi a jejich významem pro současnou dobu. V historii náboženství docházelo k řadě konfliktů a ty měly vliv na současnou podobu práv a povinností, které k náboženství přistupují. Zkoumána je role státu a také možnosti, jak přistupovat k náboženství. Existují mezinárodní smlouvy, které zavazují k ochraně náboženských svobod, ale nepostihují celou problematiku. Proto byly zkoumány zákonné úpravy v českém právu a vyvozeny kritické připomínky. Byla také popsána role státu, který je sekulární a v České republice extenzivní a neposkytuje veřejný prostor náboženství. Problematika náboženských práv a povinností není jednoznačná, což odráží závěry práce. Stanoviska Evropského soudu pro lidská práva jsou různorodá a je těžké pro občana se v nich orientovat. Mnoho případů omezování náboženských svobod je specifických a vyžadují konkrétní znalosti případu. Přesto je v České republice a v Evropské unii sekulární státy, který plní svoji funkci a je minimálně omezován náboženstvím a náboženství dává dostatečný prostor.

Abstract:

Limits and freedoms of religious belief are complex issues. This work first deals with historical contexts and their significance for the present time. In the history of religion, there have been many conflicts and these have had an impact on the current form of rights and obligations that approach religion. The role of the state is examined, as well as the possibilities of how to approach religion. There are international treaties that oblige to protect religious freedoms, but they do not cover the entire issue. That is why legal regulations in Czech law were examined and critical comments were made. The role of the state, which is secular and extensive in the Czech Republic and does not provide a public space for religion, was also described. The issue of religious rights and obligations is not unambiguous, which reflects the conclusions of the work. The opinions of the European Court of Human Rights are diverse and it is difficult for a citizen to navigate in them. Many cases of restriction of religious freedoms are specific and require specific knowledge of the case. Nevertheless, the Czech Republic and the European Union are secular states that fulfill their function and are minimally limited by religion, and religion is given sufficient space.
