Analýza aktérů a mechanismů odpovědných za ochranu právního státu EU

Abstract:

Ústavní rámec Evropské unie (EU) sleduje konkrétní základní hodnoty. Jedním z nich je přísné dodržování právního státu, což je povinnost všech členských států. Právní stát zajišťuje lepší správu věcí veřejných a zároveň prosazuje svobody a práva pro všechny lidi v regionu. Hlavním cílem právního řádu EU, který vychází z minulých konfliktů a válek v Evropě, včetně období po druhé světové válce a nacistického Německa, je zabránit opakování takových situací. Avšak v roce 2010 se do popředí zájmu začaly dostávat nové diskuse a obavy z demokratického sestupu a sestupu právního státu. Instituce v Evropě potvrdily, že různé změny provedené v soudnictví, které stíraly hranice mezi výkonnou mocí a politiky, včetně soudnictví, vedly k porušování závazků v oblasti právního státu a právního řádu. Probíhající události EU tak později vedly k odstranění prvků právního státu ze strany vlády, jako je nezávislost soudnictví a dělba moci. Vzhledem k tomu, že právní stát je jednou z primárních hodnot EU, pokud jde o článek 2 Smlouvy o EU, rozvinuly se nové diskuse o tom, jak lze bránit hodnoty EU, a co je důležitější, právní stát. Tato práce se ponoří do diskusí o aktérech a mechanismech odpovědných za ochranu právního státu z kontextu EU a zároveň ukazuje současný stav a další alternativní způsoby obrany právního státu. Po nastínění hlavních pojmů souvisejících s právním státem se zabývá jeho právním postavením, upadáním a proč je to pro Unii problematické. Závěr vytváří základ pro doporučení, která lze v budoucnu použít k ochraně právního státu.

Abstract:

The constitutional framework of the European Union (EU) follows particular core values. One of them is strict Rule of Law (RoL) adherence, an obligation based on all the member states. The rule of law ensures better governance while upholding freedoms and rights for all the people in the region. Drawing from past conflicts and wars in Europe, including post-Second World War and Nazi Germany, the EU legal order's main objective is to prevent such situations from happening again. However, in 2010, new discussions and concerns about democratic backsliding and the rule of law started to take centre stage. The institutions in Europe confirmed that the different changes made to the judiciary, which blurred lines between the executive and politicians, including the judiciary, led to the violations that were seen in the obligations on the rule of law and legal order. Ongoing EU events have thus later seen the dismantling of elements in the rule of law by the government, like judiciary independence and separation of powers. Since the rule of law is one of the primary EU values regarding the Treaty on the EU from Article 2, new debates have evolved on how the EU values can be defended and, more importantly, the rule of law. The current thesis delves into discussions on the actors and mechanisms responsible for protecting the rule of law from the EU context while showcasing the current state of play and other alternative ways used to defend the rule of law. After outlining the main concepts pertinent to the rule of law, it discusses its legal status, backsliding, and why this is problematic to the Union. The conclusion sets a basis for recommendations that can be used in future to safeguard the rule of law.
