Legal aspects of debt relief of natural person

Abstract:

Bakalářská práce se zabývá jednou z forem úpadku, konkrétně oddlužením fyzických osob dle zákona č. 182/2006 Sb. Teoretická část nabízí čtenářům základní koncept a úvod do této problematiky. Práce je rozdělena do kategorií, které rozebírají základy insolvenčního práva, osobu insolvenčního správce, formy úpadku a zaměření na oddlužení. Cílem bakalářské práce je vysvětlení pojmů insolvenčního řízení, uvedení do základního přehledu zákona a forem řešení úpadku. Praktická část poté zpracovává případové studie zaměřených na jednotlivá insolvenční řízení s dlužníky v rozdílných finančních a majetkových situacích. Tato řízení na závěr společně porovnává.

Abstract:

This bachelor thesis covers one of the forms of bankruptcy, specifically debt relief of natural persons within the confines of law no. 182/2006 Sb. The theoretical part will offer the reader an introduction to the basic concept of this matter. The thesis is divided into several parts, which describe the basics of insolvency law, the role of an insolvency trustee, and the different forms of bankruptcy with a focus on debt relief. The goal of this bachelor thesis is to explain the various terms within the insolvency procedure, its relation to the law and other forms of resolution of bankruptcy. The practical part will then describe case studies focused on particular insolvency proceedings with debtors of different financial standing and property situations. The final part will then compare these proceedings.
