Instruments of direct democracy in the Czech Republic

Abstract:

Tato práce pojednává o přímé demokracii v České republice, objasňuje základní pojmy související s uplatňováním přímé demokracie a také poukazuje na možné nežádoucí důsledky přímé demokracie. Práce sleduje vývoj přímé demokracie v právním řádu České republiky, zejména návrhy zákonů na přijetí zákona o celostátním referendu. V návrzích zákonů se liší oblasti, o nichž se připouští rozhodovat v referendu, způsob vyhlášení či kvorum platnosti. Práce dále sleduje vývoj obecního „místního“ referenda i krajského referenda. Je zde i zmíněna otázka zavedení přímé volby starostů a hejtmanů, o které se v posledních letech často diskutuje. Práce se zabývá i přímou volbou prezidenta, která je v právním řádu České republiky zakotvena již druhé volební období. Práce se zabývá právní úpravou přímé demokracie ve Slovenské republice jakožto jedním z nástupnických států československé federace a zároveň srovnáním s Českou republikou. Je zde představen vývoj právní úpravy i praktické zkušenosti s celostátním referendem na Slovensku.

Abstract:

This diploma thesis deals with direct democracy in the Czech Republic, explains the basic concepts related to the exercise of direct democracy and also points out the possible undesirable consequences of it. The work follows the development of direct democracy in the legal order of the Czech Republic, especially the bills about the national referendum that differ in the areas that are allowed to be decided in a referendum, the manner of announcement of the referendum and the quorum of validity. Besides that, the work follows the development of the municipal "local" referendum and the regional referendum. There is also mentioned the implementation of direct election of mayors and governors, which has been frequently discussed in recent years. Moreover, the thesis deals with the direct election of the president, which is already enshrined in the legal order of the Czech Republic for the second term. Furthermore, the thesis is concerned with the legal regulation of direct democracy in the Slovak Republic as one of the successor states of the Czechoslovak Federation, and at the same time, it compares the Slovak system with the Czech Republic. In connection with that, the development of legal regulations and practical experience with the national referendum in Slovakia are presented in the paper.
