The Reflection of Public International Law in Domestic Legislations

Abstract:

This thesis examines how public international law reflects within domestic laws through an analysis of the dynamic between international legal duties and national legal structures. The study evaluates the process through which states bring international law into their domestic legal order along with the legal mechanisms utilized for this purpose and identifies the conflicts that emerge between international standards and national norms. The research explores monism and dualism as distinct perspectives on international and domestic law relationships while examining their impacts on sovereignty, judicial practice, and legislative development. The research showcases countries with monist and dualist approaches, including the United Kingdom, the Netherlands, and Germany. The study demonstrates the methods various legal frameworks employ to fulfill international responsibilities. The study examines the real-world effects that international law has on business environments through a detailed analysis of trade agreements, investment regulations, environmental policies, and labor laws. The Paris Agreement alongside CEDAW and the Rome Statute serve as fundamental examples of international legal standards influencing domestic policies and corporate compliance frameworks. The research highlights how national laws must align with international agreements to preserve both state sovereignty and global legal responsibilities. The research provides valuable perspectives on legal precedents and arbitration decisions which help advance the broader effort to achieve harmonization between international law and domestic legal systems.
