Abstract:

Dohoda o vině a trestu je nový institut, který byl do trestního řízení v České republice začleněn v roce 2012. Její podstatou je dohoda mezi státním zástupcem a obviněným, který prohlásí, že spáchal skutek, pro který je stíhán, a následně státní zástupce přihlédne k této skutečnosti při ukládání trestu. I přes výše uvedené je zde nutné zmínit roli soudu, jehož úkolem je schvalovat dohodu o vině a trestu. Práce se nejprve zaměřuje na odklony v trestním řízení v obecné rovině a stručně vymezuje jednotlivé odklony trestního řízení - trestní příkaz, podmíněné zastavení trestního stíhání a podmíněné odložení podání návrhu na potrestání a narovnání. Diplomová práce se následně soustředí na historický vývoj institutu dohody o vině a trestu se zaměřením na český právní řád. Hlavní důraz práce je ale kladen na analýzu současné právní úpravy dohody o vině a trestu, která od svého zavedení do českého právního řádu v roce 2012 doznala několika změn. Tyto změny (např. zrušení nutnosti povinné obhajoby nebo zrušení nemožnosti využít tento institut v případě trestního stíhání pro zvlášť závažné zločiny) jsou podrobně vysvětleny a analyzovány, stejně jako další významné aspekty: jednání o dohodě o vině a trestu, postavení poškozeného v rámci tohoto jednání, procesní postup soudu při schvalování návrhu na sjednání dohody o vině a trestu. Práce se dále zabývá institutem prohlášení viny, který s dohodou o vině a trestu souvisí. Důležité je také srovnání české a slovenské právní úpravy, kdy práce nastiňuje podobné i rozdílné aspekty a klade si otázku, zda by se v případě tohoto právního institutu bylo možné inspirovat slovenskou úpravou. Práce nastíní určitou možnost inspirace v oblasti trestání mladistvých, kdy by bylo možné v některých konkrétních případech využít dohody o vině a trestu pro mladistvé. Další možnost inspirace je pak nastíněna v oblasti ukládání trestů, kdy slovenská úprava umožňuje snížení hranice trestní sazby i pod zákonné minimum.

Abstract:

The plea agreement is a new institution that was incorporated into criminal proceedings in the Czech Republic in 2012. Its essence is an agreement between the prosecutor and the accused, who declares that he committed the act for which he is being prosecuted, and subsequently the prosecutor takes this fact into account when imposing punishment. Despite the above, it is necessary to mention the role of the court, whose task is to approve the plea agreement. The work first focuses on diversions in criminal proceedings in general and briefly defines individual diversions of criminal proceedings - criminal order, conditional suspension of criminal prosecution and conditional postponement of the submission of a proposal for punishment and settlement. The diploma thesis then focuses on the historical development of the plea bargain institute with a focus on the Czech legal system. However, the main emphasis of the work is on the analysis of the current legal regulation of the plea agreement, which has undergone several changes since its introduction into the Czech legal system in 2012. These changes (e.g. abolition of the necessity of a mandatory defense or abolition of the impossibility to use this institute in the case of criminal prosecution for particularly serious crimes) are explained and analyzed in detail, as well as other important aspects: negotiations on a plea agreement, the position of the injured party within this negotiation, the procedural procedure of the court when approving a proposal to negotiate a plea agreement. The work also deals with the institution of declaration of guilt, which is related to the agreement of guilt and punishment. The comparison of the Czech and Slovak legal systems is also important, as the work outlines similar and different aspects and asks whether, in the case of this legal institute, it would be possible to be inspired by the Slovak system. The work outlines a certain possibility of inspiration in the field of punishing juveniles, when it would be possible to use plea agreements for juveniles in some specific cases. Another possibility of inspiration is outlined in the area of imposing penalties, where the Slovak regulation allows the penalty rate to be reduced even below the legal minimum.
