Abuse of tax law from the perspective of case law

Abstract:

Tato diplomová práce ověřuje tvrzení učiněných soudy, podle kterých by mělo být zneužití práva v daňových záležitostech považováno za poslední možnost (ultimo ratio) a mělo by tak být uplatňováno s maximální opatrností. Práce využívá detailní systémovou analýzu rozhodnutí Nejvyššího správního soudu k určení, v kolika procentech případů došlo k zneužití práva ve věcech daňových. Výsledky analýzy ukazují, že Nejvyšší správní soud konstatoval v období od 1. ledna 2010 do 30. června 2023 zneužití práva v méně než 1 % případech soudních sporů týkajících se cel, daní, poplatků a ostatních daňových řízení. V průběhu práce byly identifikovány klíčové aspekty, které mohou vést finanční správu a soudy k závěru, že došlo k zneužití daňového práva. Tyto zjištěné faktory mohou přispět k většímu porozumění problematice zneužití práva.

Abstract:

This master's thesis focuses on verifying claims made by the courts that abuse of law in tax matters should be seen as a last resort (ultimo ratio) and applied with the utmost caution. The work uses a detailed systemic analysis of the decisions of the Supreme Administrative Court to determine the percentage of cases where there has been an abuse of law in tax disputes. The results of the analysis show that the Supreme Administrative Court found abuse of rights in less than 1% of the court cases concerning customs, taxes, fees, and other tax proceedings during the period from 1 January 2010 to 30 June 2023. Additionally, the thesis identifies key aspects that could lead the financial administration and courts to conclude that there has been an abuse of tax law. These identified factors can contribute to a greater understanding of the issue of law abuse.
