European Integration of Electricity Market - Legal Issues

Abstract:

Tato práce si klade za cíl analyzovat integraci trhu elektřinou v Evropské unii s ohledem na její právní aspekty. Práce nejprve obecně zkoumá povahu elektřiny, její výrobu, přenos, distribuci a spotřebu, poté právní úpravu trhu elektřinou v EU (včetně nejnovějšího vývoje unijní legislativy – tzv. třetího liberalizačního balíčku) a ve vybraném členském státě EU, České republice. Navíc se práce krátce zabývá i právní úpravou obchodu s elektřinou mezi EU a třetím státy. Autorka dochází k závěru, že integrace trhu elektřinou, která je v EU považována za zboží a její dodávky za službu, je ambiciózní projekt, který zatím není u konce. V současné době patří trh elektřinou mezi sdílené pravomoci a jeho hlavní úpravu v unijní legislativě představují směrnice Evropského parlamentu a Rady 2003/54/ES, o společných pravidlech pro vnitřní trh s elektřinou a o zrušení směrnice 96/92/ES, ve znění pozdějších předpisů, nařízení Evropského parlamentu a Rady č. 1228/2003/ES, o podmínkách přístupu do sítě pro přeshraniční obchod s elektřinou, ve znění pozdějších předpisů, a směrnice Evropského parlamentu a Rady Evropské unie č. 2005/89/ES, o opatřeních pro zabezpečení dodávek elektřiny a investic do infrastruktury, ve znění pozdějších předpisů. Judikatura Soudního dvora EU není v oblasti liberalizace trhu elektřinou zatím příliš rozvinutá a přes nemalé pokroky v posledních 20 letech zůstává trh elektřinou v EU stále fragmentován. Mezi největší problémy patří neimplementace směrnic členskými státy, nedostatečné propojení národních trhů elektřinou a nepostačující investice do přenosových sítí.

Abstract:

This thesis aims to analyze the integration within the internal market for electricity in the European Union from a legal perspective. Firstly, it examines the concept of electricity; its production; transmission; and distribution, subsequently addressing its consumption. Then, it deals with the legal regulation of the internal market in electricity within the European Union, including recent legislative changes (the so-called third liberalisation package), as well as in one of its member states; the Czech Republic. Further, the trade in electricity between European Union and the third countries will be considered. The author concludes that the integration of the internal market in electricity, which is considered to be a good within the EU, in contrast to the supply of such, which is considered to be a service, is an ambitious project that is as yet unfinished. Currently, the European internal market in electricity falls within the area of shared powers. In particular, it is regulated by Directive 2003/54/EC of the European Parliament and of the Council of 26 June 2003 concerning common rules for the internal market in electricity and repealing Directive 96/92/EC, Regulation 1228/2003/EC of the European Parliament and of the Council of 26 June 2003 on conditions for access to the network for cross-border exchanges in electricity and Directive 2005/89/EC of the European Parliament and of the Council of 18 January 2006 concerning measures to safeguard security of electricity supply and infrastructure investment. The jurisprudence of the European Court of Justice is not particularly extensive in this area and, despite the considerable development during the last 20 years, the internal market in electricity remains fragmented in the European Union. The main challenges faced include non-implementation of directives in the member states, insufficient interconnection between national markets in electricity and inadequate investments into the transmission networks.
