The rectification of inaccurate legal act

Abstract:

Má diplomová práce je zaměřena na nápravu vadných správních aktů. V první části diplomové práce vymezuje definici pojmu správní akt, jeho charakteristice a vlastnostem a také pojmu vadný správní akt. Rozebrány jsou i důvody, které způsobují vadu správního aktu. V další kapitole jsem shrnula nicotnost správních aktů. Zejména pak důvody, které způsobují nicotnost správního aktu. V této kapitole je rozebráno i prohlášení nicotnosti správního aktu a kdo jej může činit. Zde poukazuji i na částečnou nadbytečnost úpravy – zejména nadbytečnost ve výčtu osob, které mohou podat podnět k prohlášení nicotnosti správního aktu, kdy nicotnost správního aktu se zjišťuje z moci úřední. Poslední kapitola je věnována samotné nápravě vadných správních aktů, a to pouze řádným opravným prostředkům ve správním řízení, tedy odvolání, rozkladu, odporu a námitce. Každý řádný opravný prostředek je pak rozebrán v samostatné podkapitole. Jako první řádný opravný prostředek jsem vymezila odvolání, jelikož se jedná o nejvíce frekventovaný řádný opravný prostředek. Druhý v pořadí jsem vymezila rozklad a zároveň velmi důležitou problematiku rozkladové komise, která je upravena nejen ve správním řádu, ale i např. v daňovém řádu. Předposlední řádný opravný prostředek, který jsem vymezila, je odpor, společně s příkazním řízením. Jako poslední řádný opravný prostředek jsem vymezila námitku, která se využívá v exekučním řízení.

Abstract:

My thesis is focused on remedy of defective administrative acts. The concept of an administrative act is defined in the first part of the thesis. Moreover, its characteristics and properties as well as the term of defective administrative act are analyzed. Furthermore, the reasons that generate the defective administrative act are explained. In the next chapter the nullity of administrative acts are summarized and in particular the reasons that cause the nullity of the administrative act. In this chapter the declaration of nullity of administrative act is discussed and who may carry it out. In this part it is referred to partial redundancy of arrangements - particularly redundancy in the list of persons who may lodge a declaration of nullity of the administrative act when the nullity of the administrative act is determined ex officio. The last chapter is dedicated to remedy of the defective administrative acts in the way of proper remedies in administrative proceedings which are appeals, decomposition, resistance and objection. Thereafter, each proper remedial tool is analyzed in an individual subsection. The appeal is defined as a first due remedy since it is the most frequent due remedy. The second defined remedy is the decomposition together with a very important issue of an appeal committee which is regulated not only in administrative systems but also in tax regulations (e.g.). The resistance is the penultimate specified ordinary appeal together with the issuing of instructions proceedings. Finally, it is defined the objection which is used in enforcement proceedings. The main goal of this thesis is to assess the current legal system and if necessary to propose possible solutions of this legislation.
