Banking contracts – banking terms and conditions

Abstract:

Bakalářská práce se zabývá smlouvami bankovních služeb, obchodními podmínkami, zkoumáním souladu obchodních podmínek se zásadou poctivého obchodního styku, zkoumáním souladu VOP s dobrými mravy a s ustanoveními na ochranu spotřebitele. V bakalářské práci jsem vyjádřil své názory, návrhy a opatření Obecně se zmiňuji o smlouvách bankovních služeb, tak jak je zná obchodní zákoník. K jednotlivým smlouvám uvádím příklady použití a své poznámky. Zabýval jsem se spotřebitelskou problematikou, zkoumáním souladu VOP s ustanoveními na ochranu spotřebitele. Provedl jsem průzkum v praxi, který spočíval ve sběru vzorku deseti VOP tuzemských komerčních bank, tyto jsem poté systematicky porovnával mezi sebou. V práci je podán historický vývoj institutů obchodního práva u nás, dále je uvedena komparace se zahraniční úpravou (Slovenská úprava).

Abstract:

My bachleor work is interested in bank contract services and universal business conditions. One of aim of bachleor work is checking the harmony between universal business conditions with good morals, with principe of righteous business contact and with enact of consumer protection. After I studied business terms of bank, I found that banks make their terms in conformity with principe of righteous business contact and with good morals. I accomplished small practice research, which base in collect of ten business term from internal commercial banks. That way acquired representative sample I systematic ballanced with each other. In my bachleor work I mentioned about difference in business terms for clients, who are conduct business and for clients who are not conduct business. I devoted the matter of making contracts among bank on one side and client on other side. I was interested in status of clients who are followed from this contractual stance. I checked the concord of universal bank conditions with valid law (for ex: code of business no. 513/1991 cap., code of consumer protection no. 634/1992 cap., code of civil no. 40/1964 cap.). In further part of my work I was interested in problem of consumer protection. I explained what ways is possible to make a consumer protection in Czech republic. I said that in Czech republic exists material-legal and public-legal consumer protection. Banks has a interest in conformity of their business terms with law, with enact of consumer protection, with good morals and with principe of righteous business contact. According to code of civil following, that contradict in pricnipe of business contact, be able to bring about no validity or no executed obligation. For this problems I showed a court decidion. In first part of my work i shortly described evolution of institutes of commercial law in history. I mentioned about Rakousko – Uhersko, Czechoslovakia, Protektorát Čechy a Morava, Czechoslovak socialistic republic and Czech republic. Next I compare evolution of institutes of commercial law in Czech republic with evolution of commercial law in Slovak republic. It is possible to say, that evolution of institutes of commercial law in Czech republic and in Slovak republic is greatly similar. It is caused by common historical development. I hope that my bachleor work can casual help to well informed reader.
