Regulatory framework for crypto-assets in the EU

Abstract:

Bakalářská práce zkoumá způsoby expozice vůči kryptoaktivům a hodnotí přínosy a nevýhody pramenící z uvedení unijního balíčku předpisů v oblasti digitálních financí (nařízení MiCA, DORA a Pilot) v platnost pro vybrané aktéry na trhu s kryptoaktivy. V teoretické části autor klasifikuje kryptoaktiva a služby související s kryptoaktivy podle metodologie vycházející z dokumentů a právních předpisů EU, předkládá limitace této klasifikace a prezentuje důsledky nového regulačního rámce cíleného na kryptoaktiva pro trh s těmito aktivy. Cílem praktické části práce je vymezit jednotlivé přínosy a náklady pro konkrétní subjekty a pokusit se o jejich kvantifikaci za pomoci různých finančních výkazů a pracovních dokumentů útvarů Evropské komise. Výstupem práce by měla být ex ante analýza efektivnosti nákladů, která predikuje možný vývoj odvětví kryptoaktiv v EU, spolu se sumarizací přínosnosti a nákladovosti sektorové legislativy digitálních aktiv pro toto odvětví.

Abstract:

This bachelor thesis examines various ways of exposure to crypto-assets and evaluates the benefits and drawbacks stemming from the entry of the EU’s Digital Finance Package (i.e., MiCA, DORA and Pilot) into force for selected market actors. In the theoretical part, the author classifies crypto-assets and crypto-asset services based on the provisions outlined in several EU legal acts, presents the limitations of said classification, and illustrates the impacts of the new regulatory framework for crypto-assets on the market. The analytical part aims to delineate the benefits and costs for different stakeholders and attempts to quantify them by consulting multiple Commission staff financial reports and working documents. The output of this thesis is an ex-ante cost-benefit analysis that forecasts the potential evolution of the crypto-asset sector and a summary of the monetary ramifications of this sector-specific legislation for the crypto-assets market.
