Importance of Governemnt Supervision and Control over the Execution of the Municipality Delegated Authority in the Field of Transport Administrative Agenda

Abstract:

Tato práce volně navazuje na autorovu bakalářskou práci, která se zabývala výkonem dozoru a kontroly z hlediska zhodnocení stavu a kvality výkonu státní správy vykonávané v přenesené působnosti obcemi s rozšířenou působností, tzv. obcemi třetího stupně, v oblasti dopravně správní agendy. Tato práce si vytkla za cíl dále podrobněji rozpracovat téma kontroly a dozoru ve veřejné správě. K tomu je využita dostupná literatura tuzemských odborníků, zpracovávající téma veřejné a státní správy, zejména literatura vzniknuvší po roce 1989, kdy došlo k převratné změně společensko politických poměrů a byla započata cesta k opětovné demokratizaci společnosti. V další části se práce zabývá analýzou poznatků vzniknuvších z kontrolní činnosti krajského úřadu prováděné nad výkonem přenesené působnosti v obcích s rozšířenou působností ve Středočeském kraji v oblasti dopravy. Z této široké problematiky se práce zaměřuje na analýzu v oblasti projednávání přestupků na úseku bezpečnosti a plynulosti silničního provozu s akcentem na vliv bodového systému na chování účastníků silničního provozu. Dalším segmentem v oblasti dopravně správních agend, kterému práce věnuje větší prostor, je oblast získávání odborné způsobilosti cizinci, zejména těmi, kteří mají ve své domovské zemi vysloven zákaz činnosti nebo nesplňují podmínky zdravotní způsobilosti k řízení motorových vozidel. Analyzuje postup získávání odborné způsobilosti a zaměřuje se na prokazování zdravotní způsobilosti žadatelů. Toto téma je zjevně opomíjeno a funkce praktických lékařů v této oblasti je širší veřejnosti většinou neznámá. Nakonec práce okomentuje získané poznatky a jejich zpětnou aplikaci do výkonu přenesené působnosti, hodnotí význam kontrolní činnosti jako celku a zamýšlí se nad významem metodické činnosti v oblasti státní správy.

Abstract:

The topic of this dissertation theses freely picks up the threads of the author's bachelor work which dealt with the execusion of government supervision and control in the field of transport administrative agenda from the perspective of condition and quality assessment of the state administration performance being executed in delegated authority by the municipalities with municipal autority of extended powers, in other words by the municipalities of the third level. Further, this work aims to work up the theme of inspection and supervision in public administration both in-depth and in detail. Available literature of domestic experts elaborating the topic of public and state administration is used in line with this purpose, principally the literature emerging after 1989, when a dramatic social and political transformation was initiated and the path to a renewed restoration of democratic society was established. Next section of the work provides an analyses of information and current knowledge, acquired from inspection activities of the Central Bohemia Regional Authority executed in the field of transport administrative agenda when supervising the performance of their local municipalities with municipal autority of extended powers. Apart from numerous extensive problems the work focuses on analyses in area of public hearings in the sphere of driving offences against the safety and fluency of ground transportation with accent on possible influence of the point system towards the traffic participants' behaviour. Another issue in the sphere of transport administrative agenda, discussed in detail here, is the area of both health and skill eligibility to obtain a driving licence by non-residents, mainly by those who are not permitted to drive in their home country. This part of the work analyses the procedure of obtaining the above mentioned special eligibility as well as concentrates on the way of proving the health capability of the applicants. This subject is evidently neglected and especially the role of general practitioners in this area is mostly unknown to wider public. Finally, the work comments on acquired findings and their feedback application into the execution in delegated authority, evaluates the significance of supervisory and inspection activities as a whole and ponders upon the importance of systematic and methodical activities in the area of state administration.
