Bank's Receivables and its Reinsurance

Abstract:

Bakalářská práce představuje téma pohledávek banky a jejich možné způsoby zajištění. V úvodu nabízí krátký exkurz do historie bankovnictví a právního vývoje zajišťovacích prostředků. Další kapitola je zaměřena na pohledávky z pohledu nového občanského zákoníku a bankovní praxe. Věnuje se také činnosti České národní banky, která provádí dohled a regulaci bankovních aktivit. Navazující kapitola přináší pohled na nejběžnější formy bankou využívaných zajišťovacích prostředků a v rámci jednotlivých druhů zajištění poukazuje na jejich klady a zápory. V závěru je pozornost věnována uhrazovací funkci zajišťovacích nástrojů v kontextu s aktuálními právními předpisy.

Abstract:

This bachelor thesis introduces a topic of bank receivables and different ways of its reinsurance. In the beginning it offers a short excursion into the history of banking and legal means of reinsurance. Next chapter focuses on receivables from the point of view of the new Civil code and banking practice. It also pays attention to activities of the Czech National Bank which oversee and regulate banking activities. Following chapter brings a close look at the most commonly used means of reinsurance used by the banks showing advantages and disadvantages of the different types. In the end focus is placed on means of payments of the reinsurance in the context of the current code of law.
