Administrative Juditiary in theory and in the practise of the central administrative authority

Abstract:

Téma mé diplomové práce jsem si vybral proto, že se správním soudnictvím zabývám v rámci své práce na Ministerstvu životního prostředí ČR. První částí je teoretická část, která řeší vývoj správního soudnictví na našem území od doby Rakousko - Uherska do současnosti. V druhé části práce se zabývám reálnými případy správního soudnictví z mé praxe na odboru výkonu státní správy VII Ministerstva životního prostředí ČR vybranými monotématicky z oblasti vodního hospodářství. Na základě rozboru rozsudků správních soudů, které řešily moje vlastní správní rozhodnutí nebo rozhodnutí mých kolegů, srovnávám teorii a praxi správního soudnictví. V závěru práce hodnotím stávající stav správního soudnictví v ČR a doporučuji de lege ferenda na základě vlastní správní praxe náměty ke zlepšení současného stavu správního soudnictví v ČR.

Abstract:

The topic of my thesis is administrative judiciary, which I have chosen because it is close to my responsibilities at the Ministry of Environment. In practice I deal with the administrative judiciary in cases of court review of my own decisions or of my colleagues decisions by administrative courts. I deal with the administrative judiciary terms, its functions and definitions used by various authors in the first part of this work. The next part describes several representative administrative judiciary systems in the European Union. The following part describes the administrative judiciary development in the Czech Republic in several stages from its establishment in 1867 in Austria-Hungary up to now.The next part deals with the former law regulation of administrative judiciary according to part 5 of Code of Civil Procedure no. 99/1963 of Coll. A part on the substitution of the Supreme Administrative Court by the Constitutional Court is added. Then I described my own practical experience with the administrative judiciary with High Court in Prague, which was responsible for administrative cases of the Ministry of Environment and where the first process on positive competence in water management was held in 1996 between the Ministry of Environment and the Ministry of Agriculture.In the next part of my work I looked into the current legal regulation of the administrative judiciary in the Czech Republic, valid since 1 January 2003 and included in law no. 150/2002 of Coll. on court administrative regulations. Moreover,this part includes specific cases of administrative judiciary taken from the practice of the author at the Ministry of Environment.The leitmotif of all these cases is a view of the process on a positive question of jurisdiction between the Ministry of Environment and the Ministry of Agriculture on water management and its development in time at various courts. In the conclusion of my work, there are topics de lege ferenda directed at an improved condition of administrative judiciary in the Czech Republic.
