External Relations of the EU, Conflict of Competences

Abstract:

Práce se pokouší nastínit obrysy problému konfliktu kompetencí ve vnějších vztazích ES/EU a jeho vývoje, jejím cílem je popsat a analyzovat některé z mnoha jeho problémů a dotknout se možného budoucího směřování řešení problému konfliktu kompetencí ve vnějších vztazích ES/EU. Za tímto účelem definuje pojem vnějších vztahů, zabývá se jeho historickým vývojem, věnuje se roli Evropského soudního dvora při formování dělby pravomocí a jeho rozhodnutím, postavení Evropských společenství a Evropské unie v mezinárodním právu, jejich mezinárodněprávní suverenitě a subjektivitě. Zásadní část práce je věnována dělbě pravomocí mezi Unii, Společenství a členské státy, konfliktním liniím a problémům vznikajícím při dělbě pravomocí a nejednotnosti ve vnější reprezentaci Unie, Společenství a členských států. Nakonec práce zmiňuje změny v dělbě pravomocí v oblasti vnějších vztahů nastolené Lisabonskou smlouvou. Práce se snaží ověřit, zda s postupující integrací roste ve vnějších vztazích míra autonomie rozhodování orgánů a institucí Evropské unie na úkor pravomocí členských států v této oblasti.

Abstract:

This thesis attempts to sketch outlines of competence conflict problem in external relations of EC/EU. Aim of this thesis is to describe and analyze some from many of its problems and their potential solutions and touch possible future direction of this problem. For this purpose the thesis defines the conception of external relations, deals with its development and with the role of European Court of Justice in defining the division of competences. The thesis also handles with the international sovereignty and subjectivity of Community and Union. The esential part of this thesis deals with division of competences in external relations of European Community and European Union, the conflict lines and other problems connected with division of competences. Finaly the thesis mention changes introduced by Lisbon treaty. The main purpose of this thesis is to verify, if the measure of autonomy of EU institutions in decision making is growing with progressing integration at the expense of the member states.
