Deficiencies in the Legislation of Selected Excise Duties

Abstract:

Předmětem této diplomové práce jsou nedostatky v právní úpravě vybraných akcízů z pohledu celního úřadu jako správce daně se zaměřením na pěstitelské pálení. Úvodní část práce je zaměřena na představení právní úpravy, charakteristiku a systém zdaňování alkoholických nápojů s důrazem na sazbu daně jako konstrukčního prvku. Kapitola pěstitelské pálení přibližuje zkoumanou materii z pohledu ekonomického i právního. Druhá část práce identifikuje slabiny stávající právní úpravy zdanění lihu v případě pěstitelského pálení a navrhuje způsoby jejich nápravy de lege ferenda.

Abstract:

The subject of this diploma thesis is the Deficiencies in the Legislation of Selected Excise Duties from the point of view of the customs office as a tax administrator with a focus on fruit growers‘ distillation. The introductory part of the work deals with the presentation of the legislation and of the system of taxation of alcoholic beverages with an emphasis on the tax rate as a structural element The chapter Fruit growers‘ distillation provides an economic and legal view of the researched matter. The second part of the thesis identifies the weaknesses of the current alcohol tax legislation in the case of the fruit growers‘ distillation and suggests ways to remedy them de lege ferenda.
