The development of a form of social dialogue in the Czech Republic with a focus on works councils and the European Works Council

Abstract:

Tato práce objasňuje postavení evropské rady zaměstnanců, rady zaměstnanců a zástupce pro oblast bezpečnosti a ochrany zdraví při práci, které plní funkci zástupců zaměstnanců sui generis v sociálním dialogu. V práci je mimo jiné řešena otázka přiznání právní subjektivity radě zaměstnanců, která byla zřízena za účelem zajištění práva pracovníků na informace a projednání a vytyčení rozdílů rady zaměstnanců vůči odborové organizaci. V postavení rady zaměstnanců sehrál významnou roli nález Ústavního soudu, sp. zn. Pl ÚS 83/06, díky kterému došlo k posílení pozice rady a možnosti koexistence s odborovou organizací. Přesto však nadále v platné právní úpravě existují některá úskalí, která radě zaměstnanců znesnadňují výkon její činnosti, např. složitost voleb či formulace ustanovení § 19 odst. 2 zákoníku práce. V práci je zohledněna platná vnitrostátní právní úprava a její vazba na evropské právní normy.

Abstract:

This paper clarifies the position of the European Works Council, the works council and the representative in the field of health and safety at work, which performs the function of employee representatives sui generis in social dialogue. Inter alia this paper looks into the question of granting legal subjectivity of the works council, which was established to ensure workers' rights to information and consultation and identification of differences between works council and labor union. The position of works council played an important role in the Constitutional Court, file no. Pl US 83/06, thanks to which came to strengthening of the position of the works council and to possibility to coexist with the labor union. However, in the current legislation there still exist some pitfalls that make it difficult for works council to carry out its activities, such as the complexity of the election or wording of § 19 para 2 of the Labour Code. The paper takes into account the relevant national legislation and its relation to European legal standards.
