Subjects of the Criminal Proceedings and their Rights in Stage of the Procedure before the Criminal Prosecution

Abstract:

Bakalářská práce je věnována subjektům trestního řízení a jejich právům, a to se zaměřením na fázi postupu před zahájením trestního stíhání. Stěžejní část práce se zaměřuje na praktické problémy spojené s aplikační praxí, konkrétně otázce nahlížení do spisů či taktickým aspektům při postupu policejního orgánu ve fázi prověřování s důrazem na zamezení úniku informací z trestního spisu. Práce vychází mimo jiné z poznatků a zkušeností každodenní policejní praxe, což bylo přínosné při formulování úvah de lege ferenda v jejím závěru.

Abstract:

The bachelor thesis is dedicated to the subjects of criminal proceedings and their rights, focusing on the stage of the procedure before the beginning of criminal prosecution. The crucial part of the thesis focuses on practical problems associated with application practice, specifically the issue of access to the files or the tactical aspects of the procedure of the police authority in the pre-trial proceedings, with an emphasis on preventing information leakage from the criminal file. Among other things, the thesis is based on the knowledge and experience of everyday police practice, which was useful when formulating considerations de lege ferenda in its conclusion.
