The Court of Justice of the European Union

Abstract:

Soudní dvůr Evropských společenství se skládá ze tří soudních orgánů: Soudního dvora projednávajícího významově nejdůležitější řízení, Tribunálu vzniklého v 80. letech primárně za účelem odlehčení Soudního dvora a Soudu pro veřejnou službu Evropské unie. 25 soudců Soudního dvora zastupuje 25 členských států na dobu 6 let. Není omezení na počet funkčních období. Nedílnou součástí Soudního dvora jsou i generální advokáti. V současnosti je jich 8. Jejich úkolem je nestranně připravovat podklady pro rozhodnutí soudců. Soudci s jejich názorem nemusí souhlasit. Před Soudním dvorem se vedou zejména řízení pro nesplnění povinnosti státem, o neplatnosti aktu Společenství, o nečinnosti orgánu Společenství, o předběžné otázce, o opravném prostředku proti rozhodnutí Tribunálu a o námitce protiprávnosti. Před Tribunálem se vedou řízení ve věcech duševního vlastnictví, na náhradu škody, na základě rozhodčí doložky apod. Ve většině aspektů je tento soud podobný Soudnímu dvoru. Soud pro veřejnou službu se skládá ze sedmi soudců jmenovaných jednomyslným usnesením Rady Evropské unie. Řeší spory mezi orgány Evropských společenství a jejich zaměstnanci a úředníky. Práce popisuje některé praktické aspekty řízení před Soudním dvorem Evropských společenství a zabývá se judikaturami se vztahem k České republice.

Abstract:

The Court of Justice of the European Union consists of three law enforcement agencies: The Court of Justice hearing the most important law-suit, The General Court created in 80s primary for the reason of relieving The Court of Justice and of Civil Service Tribunal of European Union. 25 judges of The Court of Justice stand for 25 members for the duration of 6 years. There is no limit for the number of term of offices. Integral part of the Court of Justice are the Advocates general. In the meantime there are eight of them. Their duty is to disinterestedly prepare the background papers for judgements of the judges. Judges do not have to agree with their pronouncements. At the Court of Justice are conducted mainly the proceedings of failure to fulfil obligations, of invalidity of acts, of failure to comply of organs, of preliminary ruling, of legal remedies against the decision of the General Court and plea of illegality. The General Court intance is mainly hearing the legal proceedings of intellectual property, compensation for damages, cases based on arbitration cause and so on. In the most aspects this court is similar to the Court of Justice. The Civil Service Tribunal consists of seven judges nominated by the unanimous resolution of the Council of Europe. This thesis describes some practical aspects of the legal proceedings of the Court of Justice of the European Union and inquires into decisions of the courts related to the Czech Republic.
