Abstract:

Diplomová práce se zabývá problematikou vyšetřování loupeží. Tento trestný čin je považován za jeden z nejnebezpečnějších deliktů. Je tomu tak nepochybně proto, že pachatel tímto činem útočí za pomoci fyzického násilí nejen na majetek jiného, ale především na osobní svobodu. Závažnost loupeže však sahá mnohem dál než ke škodám způsobeným na zdraví a majetku osoby. Je nutné brát zřetel na to, že loupeže mají nemalý dopad i na celou společnost, jelikož jejich výskyt markantně oslabuje pocit bezpečí u lidí a vnáší do povědomí společnosti pocity ohrožení z možného napadení, a tím negativně ovlivňují normální chod a kvalitu společenského života. Proto je nesmírně důležité, aby tyto činy byly řádně vyšetřeny, objasněny a pachatelé posléze spravedlivě potrestáni. Práce si klade za cíl zpracovat ucelené informace o specifikách metodiky vyšetřování loupeží a podat tak celistvý pohled na proces vyšetřování. Nejprve čtenáře seznámí s historickým vývojem tohoto trestného činu, poté s jeho platnou právní úpravou dle trestního zákoníku č. 40/2009 Sb. Dále je v práci věnována pozornost kriminalistické charakteristice loupeže, kde jsou popsány kriminální situace, způsoby páchání loupeží, pachatelé, jejich motivy a oběti těchto zločinů. V práci jsou charakterizovány i typické stopy vznikající v průběhu loupežné trestné činnosti a typické vyšetřovací situace. Stěžejní část práce pojednává o zvláštnostech vyšetřování loupeží, s důrazem kladeným na počáteční a následné úkony. Poslední část práce je věnována sdílením autorčiných dojmů z rozhovoru s kriminalisty, kteří se svěřili s praktickými zkušenostmi ohledně zkoumaného problému vyšetřování loupeží.

Abstract:

The thesis deals with investigation of robbery, which is considered one of the most dangerous forms of misconduct. This is undoubtedly because the perpetrator, in addition to using physical violence, attacks both the property and the freedom of another person. The impact of the robbery, however, goes much further than the damage to the health and property of the person. It must be remembered that robberies have a considerable impact on society as a whole, as their occurrence significantly weakens people's sense of security and brings to society an awareness of possible attacks, thereby negatively affecting the normal functioning and quality of social life. It is therefore extremely important that these acts be properly investigated and solved, with the perpetrators punished fairly. The aim of this thesis is to deal with comprehensive information about the specifics of robbery investigation methodology and give a holistic view of the investigation process. The reader will first become acquainted with the historical development of this crime, then with its current legislation under the Criminal Code No. 40/2009 Sb. Furthermore, attention is paid to the criminal characteristics of robbery, which includes criminal situations and different ways of committing robberies, as well as information about perpetrators, their motives, and the victims of these crimes. The work also characterizes the typical evidence arising from a robbery and the typical investigative situation. The main part of the thesis deals with the peculiarities of robbery investigation, with an emphasis on initial and subsequent acts. The last part of the thesis is devoted to sharing the author's impressions of interviews with criminologists who shared their practical experience with the procedures of robbery investigations.
