Use of the institute of circumstance excluding the illegality of extreme urgency and its practical application

Abstract:

Cílem bakalářská práce je popis využití krajní nouze a znázornění její praktické aplikace. V úvodu je nastíněn cíl, téma a způsob zpracování tohoto dokumentu. V teoretické části práce je popsán vývoj soukromé bezpečnosti a právní postavení soukromých bezpečnostních služeb. Následuje vymezení trestněprávních institutů, trestní odpovědnosti a trestu, neboť jsou to důležité pojmy pro pochopení podstaty okolností vylučujících protiprávnost. Teoretická část nadále vymezuje obecně okolnosti vylučující protiprávnost a podrobněji specifikuje institut krajní nouze, který je hlavní náplní celé práce. V závěru teoretické části definuje rozdíl mezi nejčastěji zmiňovanými okolnostmi, tedy mezi krajní nouzí a nutnou obranou. Praktická část vymezuje praktickou aplikaci krajní nouze v podobě soudních judikátů Nejvyššího soudu České republiky. Celou práci uzavírá závěr, který shrnuje naplnění stanovených cílů.

Abstract:

The object of the bachelor thesis is to describe the use of necessity and to illustrate its practical use. The introduction describes the main point and method of processing this document. The theoretical part deals with evolution of private security and the legal status of private security services. The next part is a definition of criminal law institutions, like criminal liability and punishment. They are important for understanding principle of circumstances excluding the illegality. The theoretical part continues with general definition of the circumstances excluding illegality and more detailed definiton of necessity, which is the main content of the whole work. At the end of the theoretical work, is defined the difference between the most mentioned circumstances, between the necessity and the self-defence. The practical part defines the practical application of necessity in the form of court judgments of the Supreme Court of the Czech republic. The whole thesis is concluded by a conclusion that summarizes the completing of the set goals.
