Abstract:
Práce se zabývá problematikou nekalé soutěže z hlediska její judikatury. Představuje historický vývoj právní úpravy, podrobně zkoumá právní úpravu stávající, přičemž se zaměřuje především na generální klauzuli a soudcovské skutkové podstaty nekalé soutěže. Dotýká se i legislativy EU k této problematice a v závěru obsahuje úvahy o právní úpravě nekalé soutěže de lege ferenda.
Abstract:
The main content of this thesis focuses on providing the reader information about how courts in Czech Republic and its legal predecessors tend to interpret the term „unfair competition“ with everything that it comprehends. It also overviews European legislature concerning unfair competition.
