Organized Criminal Group - Possibilities and Limits its Criminal Sanctions

Abstract:

Tématem této práce je organizovaná zločinecká skupina, možnosti a limity jejího postihu. Jako taková je organizovaná kriminalita fenoméne moderní doby a domnívám se, že s rozvojem a dostupností informačních technologií se bude stále vyvíjet a její struktura bude stále více komplikovanější. Představuje velké riziko pro společnost, avšak Česká republika má podle mě dostatek právních prostředků na to, aby si s případným nástupem poradila. Bude ale do budoucna důležité takříkajíc „neusnout na vavřínech“, jako se tomu stalo počátkem devadesátých let a expanze organizovaného zločinu nejen u nás, ale prakticky v celé postsocialistické Evropě, zapříčinila veliký náskok před legislativou, který naši mírně řečeno flegmatičtí zákonodárci doháněli bezmála dvacet let. Je celkem pochopitelné, že zločin bude vždy o „krůček“ napřed, zvláště v českých „luzích a hájích“, kde je spousta chytrých hlav jak v dobrém, tak i bohužel v tom špatném smyslu slova, ovšem je v zájmu celé společnosti, aby ten pomyslný krůček byl co možná nejmenší. Domnívám se, že toho lze dosáhnout precizací již stávající právní úpravy, aby nebylo možno zákon různě obcházet a využívat tzv. skulinek v zákoně. Tato práce si neklade za cíl rozřešit problematiku organizovaných zločineckých skupin, ani organizovaného zločinu obecně, což ostatně zatím není v možnostech žádného právního systému. Snažil jsem se spíše podat komplexní obraz dané problematiky, respektive uvést dle mého názoru její nejstěžejnější body, jelikož není v možnostech této práce, zejména s ohledem na její stanovený rozsah, pojmout tak široké téma, jakým organizovaná zločinecká skupina bezpochyby je. V souvislosti s tímto jsem došel k takovémuto závěru: základní myšlenkou této práce je, že organizovaný zločin je jev, jenž je ve společnosti odnepaměti, a proto prostředky právní ochrany nelze chápat jako cosi, co má tento jev vykořenit, nýbrž by měla působit a také působí v našem právním systému spíše na poli prevence, přičemž je velmi podstatná také její represivní složka. Osobně se přikláním k tomuto postoji a s legislativou České republiky v jejích hlavních pilířích souhlasím, ačkoliv i zde se najdou výjimky, které jsem, jak alespoň doufám, ve své práci dostatečně akcentoval.

Abstract:

The topic of my thesis has been the organized criminal group, the possibilities and limits of its sanctions. Organized crime is as itself the phenomenon of modern age and concerning the development of modern technologies and the availability of information technologies I presume that it will evolve and its structure will become more and more complicated. Although organized crime poses a huge risk for the society the Czech republic has, from my point of view, sufficiency of legal instruments to manage with eventual expansion of this phenomenon. This of course could by possible only on condition that we will not be dazed by pride, as had already happend by the beginning of the 90´s when the expansion of organized crime had caused its enormous lead against the legislature not only in our republic, but to all intents and purposes in the whole ex-socialistic Europe. It is upon to place to accent that our, flegmatic, said the least of it legislators were making up for this lead almost for twenty years. It is apprehensible that crime is always being a step ahead, especially in – expresively said- the Czech dog board, where are lots of wits both in the positive but unlucky even the negative word meaning. It makes sense that taking the best interest of the socienty the imaginary step should be as tiny as possible. From my point of view it is possible to reach it by the meticulous work on current legislature to omit evasion of legislature. Concerning the feasibility of this thesis I must admit that it is not possible to solve neither the problems of organized criminal groups nor the organized crime in general which by the way is not possible in any legal system for the time being. I rather tried to present the comperhensive delineation of the vouchsafed problems, or if you like to notice the main points of it while as hereinbefore mentioned concerning the feasibility of the thesis especially its given lenght. And we must admit that the topic of organized criminal gathering is undoubtely too wide for this thesis. Within the context of this I reached the conclusion: the basic idea of this thesis is that the organized crime is phenomenon which has been in the society since time immemorial hence the instruments of legal protection cannot be taken as something which should pull up or unroot this phenomenon but it should have an effect (as it has the effect in our legal order) in the fields of prevention where as its punitive element must also be taken into consideration. Personally I incline to thereinbefore said attitude and agree with the legislature of the Czech republic by its main pillars although some exeptions could be found there. As I hope I emphasized these exeptions in my thesis assertively enough.
