Assignment of a Claim

Abstract:

Diplomová práce se zabývá problematikou postoupení pohledávky. Zprvu se věnuji obecně pojmu změn závazkových právních vztahů a podstatě postoupení pohledávky. Stěžejní část je věnována zevrubné analýze současné právní úpravy tohoto institutu v českém právním řádu, kde se snažím upozornit na celou řadu problémových aspektů, které naše právní úprava neřeší. Součástí práce je rovněž stručné nastínění vývoje právní úpravy postoupení pohledávky na našem území. V diplomové práci rovněž rozebírám problematiku postoupení pohledávky podle Principů evropského smluvního práva a Návrhu společného referenčního rámce, které představují významné projekty evropského smluvního práva. Na závěr provádím analýzu právní úpravy tohoto institutu v novém občanském zákoníku, kde věnuji zvýšenou pozornost změnám, které nová právní úprava přináší.

Abstract:

This diploma thesis deals with the assignment of a claim. Firstly, I introduce the term of change of obligations and the principle of the assignment of a claim. The main part of this thesis contains comprehensive analysis of the current Czech legislation of this institut where I highlight many problematic aspects which are not regulated. The part of this thesis is the history and development of assignment of a claim in the Czech republic. I also deal with the regulation of assignment of a claim contained in the Principles of european contract law and in Draft common frame of reference which are one of the most important projects of european contract law. Lastly, I analyze regulation of assignment of a claim in new civil code which should be effective in the future and where I focus on the main changes in the legal regulation of this institute.
