Legal and social position of the indigenous peoples in Latin America - perspectives for development

Abstract:

Práce se zaměřuje na přiblížení právního a sociálního postavení domorodého obyvatelstva v Latinské Americe, přičemž v rámci komparace je zvláštní důraz kladen na Ekvádor, Chile a Argentinu, jakožto státy s rozdílným poměrným za-stoupením domorodců. Doplňují tak obecné informace týkající se této problemati-ky. Samostatná kapitola je věnována definici pojmu ?domorodé obyvatelstvo? a kritériím identifikace domorodců jako takových. Zpracovány jsou hlavní doku-menty mezinárodního práva (Úmluva ILO č. 169 a Deklarace OSN o právech do-morodého obyvatelstva) a jednotlivé nástroje OSN pro implementaci a evidenci dodržování, resp. porušování práv domorodců. Sociální postavení je demonstro-váno na charakteristice domorodců ve vybraných státech komparace především na základě censů. Obecný nástin vývoje právního postavení je doplněn konkrét-ními případovými studiemi, které se zakládají na zakotvení práv domorodců v ústavě, resp. zákonech. Zahrnuty jsou i perspektivy dalšího vývoje se zaměřením na rozvoj

Abstract:

This paper focuses on the legal and social positions of indigenous peoples in Latin America, complete with comparisons and a particular emphasis on Ecuador, Chile and Argentina. Each of these countries represents a different ratio of indigenous peoples living in a country and the case study completes the general information regarding this issue. One independent chapter is dedicated to the term ?indigenous peoples? and the criteria of identifying oneself as indigenous. Processed are also the main documents of international legislation (Convention 169 Concerning Indigenous and Tribal Peoples in Independent Countries, Declaration on the Rights of Indige-nous Peoples) and particular UN Authorities concerning the implementation and evidence of the observing and violating of indigenous peoples´ rights. Their social position is demonstrated by the characteristic of indigenous peoples in previously mentioned countries, based mainly on census data. The general idea of the legal position?s evolution is followed by particular case studies based on the recognition of the rights of indigenous peoples in the constitution and laws. Also included are the perspectives for future progress with a special emphasis on development
