The Protection of Personality in the Health Service

Abstract:

Předmětem práce, kterou jsem zpracovala, je problematika práva na ochranu osobnosti se zaměřením na zdravotnictví a problematiku v ní se vyskytující. Osobnost fyzické osoby představuje komplex jednotlivých dílčích hodnot. Právo na ochranu osobnosti označujeme jako všeobecné osobnostní právo, které zahrnuje jednotlivé právem chráněné hodnoty osobnosti fyzické osoby. Protože je osobnost fyzické osoby značně elastickým fenoménem, vyjmenovává ústřední právní norma, která vytyčuje rámec zákonných konkretizací této oblasti, hodnoty osobnosti fyzické osoby pouze demonstrativně (život, zdraví, soukromí, jméno, důstojnost, čest atd.). Touto normou je Listina základních práv a svobod (čl. 6n.). Konkretizací ústavních ustanovení jsou ustanovení § 11n. občanského zákoníku (zák. č. 40/1964 Sb. ve znění pozdějších předpisů). Zdravotnické právo netvoří samostatné odvětví práva a nelze jej považovat za součást pouze soukromoprávní oblasti či pouze veřejnoprávní oblasti, ani problematiku zdravotnického práva není možné podřadit pod jiné právní odvětví. Ve zdravotnickém právu se od počátku 90. let postupně odrazily velké změny. Ve druhé části jsem se věnovala především dílčí hodnotě osobnosti fyzické osoby, jakou je tělesná integrita. Na právo na tělesnou integritu jsem se dívala z mnoha úhlů pohledu. Rozebrala jsem problematiku zdravotnictví a zdravotní péče, uměle přerušeného těhotenství jako práva na život, otázky sterilizace, v dnešní době velmi aktuálního problému- lékařského pokusu a výzkumu, oblasti transplantací, pitev a velmi diskutovaného tématu eutanzie v souvislosti s „právem na smrt“. V předposlední kapitole mé diplomové práce jsem zmiňovala a vysvětlovala postup „lege artis“, který byl v právní literatuře vždy značně nevyjasněný. Nejspíš z důvodu, že se nejedná o pojem právní, nýbrž ryze medicínský. Za doslovný překlad se považuje označení lege artis tedy „podle pravidel umění“ (míněno lékařského). Tento výraz stanovuje, co je v lékařské profesi považováno za správný postup.

Abstract:

The object of my dissertation is the issue of the personality protection rights with the focus on the health service and the problems related thereto. The personality of a physical person includes a complex of individual component values. We rank the right to personality protection among the general personality protection rights, which include the individual law-protected values of the personality of a physical person. As the personality of a physical person is a very elastic phenomenon, the main legal rule, which defines the framework of the legal specifications in this sphere, lists the values of the personality of a physical person only demonstratively (life, health, privacy, name, dignity, honour, etc.). This rule is the Charter of Fundamental Rights and Freedoms (Article 6n.). The provisions of Section 11n of the Civil Code (Act No. 40/1964 Coll. as amended) put the constitutional provisions more precisely. The healthcare law does not constitute a separate branch of law and it cannot be considered as a part solely of the private law or solely of the public law, and the issues of the healthcare law cannot be subordinated under any other branch of law. Great changes were reflected in the healthcare law since the beginning of the nineties. In the second part, I paid my attention especially to the component value of the physical person’s personality. I viewed the right to physical integrity from many angles. I have analysed the issues of the health service and healthcare, the artificially aborted pregnancy from the viewpoint of right to life, the issues of sterilisation, the problem (which is very topical now) of the medical research and tests, the sphere of transplantations, autopsy and the frequently discussed topic of euthanasia in relation to the “right to die”. In the penultimate chapter of my dissertation I mentioned and explained the “lege artis” procedure, which was always quite unclear in the legal literature. Most probably due to the reason that it is not a legal term, bur purely a medical one. The verbatim translation of “lege artis” is “according to the rules of art” (which means the doctor’s art). This term defines what is considered as correct procedure in the doctor profession.
